THE RIGHT OF PRIVACY AND THE RIGHT TO INFORMATION: PUBLISHING CIVIL SERVANTS´ WAGES ON THE INTERNET

Abstract

The constitutionality of the law that authorizes the broadcasting of civil servants´ wages on the Internet is discussed. Legal justification for such a measure with the publishing of name, occupation and earnings is based on the fact that the publication of the activities of Public Administration is a corollary of the principles of morality, ethics and transparency I Art 37 of the 1988 Brazilian Constitution, especially on public interests. Debate boils down to the conciliation of the right to information warranted by the Constitution with the right to privacy of civil servants who consider the process a form of interference in their private lives. The theme focuses on whether the publication by the Administration of civil servants´ data on the Internet is an offense against their privacy.
