Abstract

ABSTRACT:

CONTEXT: Complementary Law (LC) No. 150 requires the provision of services for more than two days per week for the recognition of an employment relationship and, consequently, the guarantee of social rights. On the other hand, Convention No. 189 of the International Labor Organization (ILO) does not impose any time limit, also covering day workers (domestic workers who work in the same residence for up to two days per week). The non-recognition of the employment relationship in Brazil implies exclusion from labor protection (and social security related to the employment relationship). The complementary law is applied to regulate domestic work in Brazil, while the convention is ignored. Thus, the following research problem arises: is there really a normative conflict between LC No. 150/2015 and ILO Convention No. 189?

OBJECTIVE: The main objective of this article is to compare the concepts of domestic worker present in LC No. 150/2025 and ILO Convention No. 189. The starting point is the hypothesis of incompatibility between the norms, arguing that the convention is more protective of day laborers and has supra-legal status, that is, it can be understood as a norm that has a hierarchy superior to ordinary laws and inferior only to the Federal Constitution.

METHODOLOGY: The analysis is based on Social Reproduction Theory (SRT) and developed using bibliographic and documentary research techniques. References are used with an emphasis on domestic work and the fields of Labor, Constitutional, and International Law in order to contextualize the issue addressed. Furthermore, with regard to the documentary aspect, special emphasis is placed on the analysis of ILO Convention No. 189, LC No. 150/2015, and RE 466.343-1/SP, in which the thesis of supra-legality was discussed.

RESULTS: It is concluded that, from the perspective of TRS, it is possible to understand the centrality of domestic work for the maintenance of society and the need to ensure greater protection for domestic workers. The exclusive application of LC No. 150/2015 is detrimental to day laborers, and ILO Convention No. 189 ensures greater social protection. Through the thesis of supra-legality, a proposal is presented to harmonize the norms in order to achieve a protective scope.
