VIOLATIONS OF THE PERSON´S RIGHTS AND INDEMNITY DUE TO WIKIPEDIA EDITIONS

Abstract

The basic features of Wikipedia, a phenomenon typical of the Information Society, are forwarded. Since the contents of the encyclopedia may be edited by anyone and since it has obtained a sufficient social credibility, current paper examines editions that damage the person´s rights, such as intimacy, image and honor of people and their respective indemnity. The issue of the firm´s responsibility in insertions by employees, even beyond their attributions, and the parameters for the fixation of rates for moral damage, are debated. The paper comprises a bibliographical (doctrine) and juridical analysis, with qualitative and inductive characteristics. Possible parameters that may be applied by judges in indemnity cases are provided.
