From this premise, we aim at analyzing the rights of the investigated in relation to establishing proof by the DNA genetic examination, in face of the limitations presented with the issuing of the STJ summary no 301, considering the different principles, its relativism and application in the examination of rights of the parts in the investigation of paternity, as well as the importance of proof concerning the anticipation of the effects of guardianship and the provisions of preventive nature, attempting to demonstrating its relevance, aiming at realizing the child’ material rights not yet recognized.
